Standard Terms and Conditions

Weddings · Functions · Corporate Events · Accommodation · Farm Stays
Version 1.1 · Effective for bookings confirmed from 1 September 2026 · Includes Schedules A, B and C

Important notice: risk of serious injury or death

ATILA is a rural farm with free-roaming horses, a swimming pool without a lifeguard, open water, uneven terrain, fires and moving vehicles. These conditions present material risks. The risk notice must be specifically brought to the Client’s attention and acknowledged before confirmation of an applicable booking. Children require active adult supervision. See Schedule C.

1Application and interpretation

1.1
These Terms govern reservations for weddings, private and corporate functions, organised events, accommodation and farm stays at ATILA near Bonnievale. “ATILA” means OUHOUT MEUBELFABRIEK (PTY) LTD, registration number 2017/473129/07, trading as ATILA. “Client” means the individual or entity contracting with ATILA. “Guests” include invites and overnight occupants. “Service Providers” includes independent suppliers engaged by the Client.
1.2
The services, event date, permitted areas, guest capacity, accommodation, price and particular arrangements will be identified in the written booking confirmation accepted by ATILA. A venue or service not expressly included is not reserved. Exclusive use applies only where expressly confirmed in writing.
1.3
These Terms apply to bookings accepted on or after their effective date. Terms published later do not amend an existing confirmed booking unless the parties agree in writing. Specific commercial terms agreed in the confirmed booking may supplement these Terms, but no agreement removes a statutory right that cannot lawfully be excluded.
1.4
A person booking for a company, trust or another person confirms that the person is authorised to act for the Client. An organiser, agent or coordinator is not entitled to alter ATILA’s terms, rates or commitments without written authorisation.

2Enquiries and confirmation of bookings

2.1
An enquiry, site visit, quotation or discussion of an available date does not establish a reservation. A provisional date may be held only for the period expressly confirmed by ATILA in writing, after which it expires without further notice.
2.2
A wedding or function booking is confirmed when ATILA has accepted the booking in writing, the Client has accepted the booking particulars and these Terms, the R5,000 reservation payment has cleared and the required risk acknowledgement has been completed. Payment or verbal understanding alone does not secure a date.
2.3
Accommodation-only reservations are confirmed by ATILA or its authorised booking platform when the booking confirmation is issued and the specified deposit or payment has been received. The approved occupancy, accommodation dates, tariff and facilities included are confirmed at the time of reservation. The farm risk notice must be supplied and acknowledged before acceptance.
2.4
Before electronic acceptance, the Client must be given the opportunity to review and correct booking information and withdraw without submitting the transaction. ATILA will provide an electronic copy of the accepted Terms, booking particulars and charges without cost, in a format capable of being stored or reproduced.
2.5
The ordinary seven-day cooling-off right for online transactions under the Electronic Communications and Transactions Act 25 of 2002 does not apply to accommodation, catering or leisure services agreed for specific dates or periods, as contemplated in section 42(2)(j). Any other mandatory cancellation or direct-marketing rescission right remains unaffected.

3Prices and payment

3.1
All charges are stated in South African rand. Before acceptance, the quotation, booking confirmation or online checkout must disclose the full price, applicable VAT or other statutory charges, services included and any additional charges. A confirmed price may be varied only by written agreement or where a change in law requires an applicable statutory charge.
3.2
The R5,000 payment required to secure a wedding, or function is a reservation payment credited against the Venue Hire Price. It is not an additional administration fee and is not automatically forfeited on cancellation.
3.3
Unless otherwise agreed in writing, 25% of the Venue Hire Price, less the R5,000 reservation payment already received, shall be payable 12 months before the Event Date. A further 50% shall be payable eight months before the Event Date, with the outstanding balance payable seven days before the Event Date. All payments received shall be credited towards the total Venue Hire Price.
3.4
Where an event is booked after an instalment date has passed, the instalments already due must be paid within seven days after confirmation. Where the booking is made fewer than 14 days before the event, all confirmed charges are payable before access. Catering and event-related accommodation must be paid for in full 14 days before the event on the agreed final numbers. Accommodation-only bookings follow the payment terms disclosed before reservation.
3.5
All payments shall be made to the bank account reflected on an authorised ATILA invoice or through an approved secure payment facility, quoting the relevant booking reference. The Client is responsible for independently verifying any change in banking details directly with ATILA using its established business telephone number before making payment. ATILA shall not be liable for any loss arising from payments made to an incorrect, fraudulent or unauthorised account due to the Client’s error or failure to verify the banking details. Such payments shall not discharge the Client’s payment obligations to ATILA.
3.6
Where payment is overdue, ATILA may issue written notice requiring settlement within seven days. If the default is not remedied, ATILA may cancel by further written notice and recover a reasonable cancellation charge or proven loss as permitted by law. Venue access, supplier set-up or accommodation handover may be withheld while an amount properly due remains unpaid.
3.7
Bar accounts, additional hours approved, additional accommodation and other services provided during the booking will be recorded on an itemised account. Unless otherwise agreed, an undisputed amount is payable within seven days of the invoice.

4Venue use, hours and arrangements

4.1
Weddings and functions are limited to the areas, capacity and period accepted in the booking. The standard event period is eight consecutive hours from the confirmed ceremony or commencement time. The event must conclude by the earlier of the agreed end time or the time lawfully permitted by applicable land-use conditions, event permissions, noise controls and liquor authorisations. A closing time of 02:00 is not guaranteed.
4.2
Any extension requires advance written approval and must be legally permissible. Approved additional venue and bar use is charged at R2,500 per hour or part thereof, excluding independently contracted music and other services. Where backup generation is required during an approved extended period, R1,000 per hour of actual generator operation is payable.
4.3
For a Saturday wedding, the ordinary supplier set-up period is Friday from 10:00 to 14:00. Earlier access or additional preparation time requires written approval. Where late arrival or delay by the Client or Service Providers requires ATILA staff to remain after 14:00, reasonable additional staffing is charged at R500 per hour or part thereof actually required.
4.4
The Client must provide the event programme, supplier arrival times and operational requirements at least 14 days before the function. ATILA requires reasonable adjustments to protect safety, avoid unreasonable disturbance and comply with permits. The Client remains responsible for ensuring that all privately arranged services fit the agreed programme.
4.5
Decorations, equipment and personal items must be removed by the agreed clearing time. ATILA furniture, décor, fixtures, trees, fences and installations may not be moved, rearranged, altered or used for photographic purposes or as photographic props without prior written approval. Any approved use may be subject to an additional fee agreed in advance. Unauthorised use or movement will entitle ATILA to recover reasonable costs incurred for repositioning, cleaning, restoration or damage. Restricted and residential farm areas remain inaccessible unless specifically authorised by ATILA.
4.6
An outdoor function is subject to prevailing weather and safety conditions. The Client and ATILA must agree to the available covered or indoor alternative, where applicable, before the event. A reasonable safety-related move to that agreed alternative does not itself constitute cancellation of the booking.

5Guest numbers, food and catering

5.1
Attendance may not exceed the confirmed guest number or the lawful capacity of the relevant area, whichever is lower. Any minimum guest commitment, area exclusivity or package entitlement must be disclosed in the accepted booking. ATILA may refuse additional persons where admission would breach a capacity limit or create a safety risk.
5.2
Requests to reduce the estimated number of function guests must be made in writing at least four months before the event. Later reductions may be accommodated, but charges will reasonably reflect irrevocable commitments and costs saved or avoidable.
5.3
Final meal selections, guest numbers, dietary arrangements and meals required for Service Providers must be confirmed at least 14 days before the event. Catering will be charged on the confirmed number or number served, whichever is higher. Additional guests or meals are subject to availability and written confirmation of costs.
5.4
Catering is supplied by ATILA or a caterer expressly approved in writing. An independent caterer may be required to provide a valid Certificate of Acceptability, applicable permits, adequate insurance and a signed supplier agreement. Access to the kitchen, equipment and food-storage areas remains subject to ATILA’s written conditions.
5.5
Allergies, medical dietary needs and religious or other meal requirements must be notified in writing during final menu arrangements. ATILA and its caterers will exercise reasonable care, but a kitchen handling common allergens cannot guarantee complete absence of traces. Buffet food may be removed at the end of service and must not be taken away where food-safety controls prohibit this.

6Bar, alcohol and beverages

6.1
The bar is operated only by ATILA or authorised personnel and within the applicable liquor licence and trading hours. No alcohol may be sold or supplied to persons under 18. Service may be refused to an intoxicated person or where safety or lawful service requires it. The available payment methods must be advised before the event.
6.2
Guests are responsible for individual purchases unless the Client has expressly authorised a bar account or spending limit in writing. Where a bar account is agreed, the Client is responsible for drinks properly supplied within the approved arrangement and the itemised account must be settled on the payment terms agreed before the event.
6.3
No alcohol may be brought onto or consumed on the property, including the accommodation areas, without ATILA’s prior written approval. ATILA may require unauthorised alcohol to be removed or not consumed.
6.4
Subject to written approval and the liquor licence, a reception table of eight guests may have up to two bottles of still wine and one bottle of sparkling wine supplied by the Client. Corkage of R40 applies to each Client-supplied bottle opened. Such wine is limited to the reception meal, unopened bottles remain the Client’s property and must be removed on departure.

7Independent suppliers, music and décor

7.1
DJs, musicians, photographers, florists, event coordinators, decorators and other independently appointed suppliers must be identified to ATILA at least 14 days before arrival. ATILA may require a signed supplier agreement, relevant professional permits, proof of insurance and evidence that equipment is safe before allowing access.
7.2
Independent Service Providers contract with and are paid by the Client, not ATILA, unless expressly stated otherwise in writing. They remain responsible for their own employees, statutory compliance, equipment, workmanship and safe execution of their services. ATILA may stop unsafe operations or restrict access to unauthorised areas.
7.3
Use of ATILA electricity by an independent supplier attracts a disclosed facility charge of R300 per supplier. All extensions, plugs and temporary cabling must be safe, installed without obstructing walkways and operated within the venue’s available electrical capacity. Access to distribution boards, roofs, kitchens and gas installations requires express permission.
7.4
Music, public performances and amplified sound must comply with applicable licensing, noise restrictions and the approved end time. The party legally required to hold any music licence must ensure it is current. ATILA may require sound to be reduced or discontinued when necessary to comply with applicable controls or protect the premises and neighbours.
7.5
Drones, staging, marquees, external generators, open flames, candles and special effects require prior written approval and all applicable permissions. Fireworks, firecrackers, sky lanterns and pyrotechnics are strictly prohibited. Permanent adhesives, nails, staples, glitter and unapproved confetti are prohibited. The Client shall be responsible for all reasonable costs, losses and damages arising from any breach of these requirements by the Client, Guests or Service Providers, including the costs of cleaning, removal, repair, restoration or replacement of damaged property.
7.6
The Client is responsible for appointing a legally authorised marriage officer and complying with the applicable marriage formalities. Booking a wedding ceremony at ATILA itself does not constitute the legal solemnisation of a marriage.

8Accommodation and farm stays

8.1
Ordinary check-in is from 14:00 and check-out is by 10:00. An early arrival or late departure is subject to availability and prior agreement. Where approved, early check-in is charged at R200 per hour per accommodation unit and late check-out at R250 per hour per accommodation unit.
8.2
Accommodation booked with a function must be confirmed and paid for 14 days before the event. A sleeping allocation identifying the relevant rooms, chalets and beds must be provided at least seven days before arrival. ATILA may undertake a reasonable bed-count and condition inspection on departure, with the Client or an authorised representative present arranged.
8.3
Only the approved number of occupants may stay overnight. Additional beds, persons or visitors require advance approval and are charged at the occupancy rate disclosed before use. Unauthorised or excess occupancy may be refused where it compromises safety, lawful capacity or the rights of other guests.
8.4
Accommodation areas are for residential use and reasonable quiet enjoyment. After-parties, amplified music, indoor smoking, unregistered visitors and unauthorised pets are prohibited. Assistance animals are dealt with in accordance with applicable law. Guest Cottage linen and towels may not be removed for use at the pool or elsewhere on the farm.
8.5
The Client must inform overnight guests that they are staying on a rural property and that access to farm areas and facilities may be restricted. Adult guests may be required to provide proportionate registration and emergency-contact information necessary for administration, security and safety.

9Cancellation and postponement by the Client

9.1
The Client may cancel an advance booking by written notice to the published booking or legal-notices email address. Cancellation takes effect when the notice is received. Any cancellation charge must be reasonable in the circumstances, taking account of the nature of the booking, the length of notice, the prospect of a replacement booking and general industry practice, as required by section 17 of the Consumer Protection Act 68 of 2008.
9.2
For weddings and functions, the standard cancellation scale below is calculated on the Venue Hire Price only. The stated amount is the starting point for an assessment, not an automatic forfeiture. ATILA will reduce the charge where necessary to ensure that it is lawful, fair and proportionate. Catering, accommodation and other separately priced services are not automatically included.
NOTICE RECEIVED BEFORE THE EVENT STANDARD VENUE-HIRE CHARGE
More than 12 months R5,000
12 months to more than 8 months 25% of the Venue Hire Price
8 months to more than 4 months 50% of the Venue Hire Price
4 months to more than 1 month 75% of the Venue Hire Price
1 month or less Up to 100% of the Venue Hire Price
9.3
For food, rooms, equipment and other services not provided, ATILA may recover only reasonable commitments and expenses already incurred that cannot reasonably be avoided, recovered or reused. ATILA will reasonably seek a replacement booking and account for any income recovered against the same loss, after reasonable replacement-booking costs.
9.4
For accommodation-only reservations, the standard position is no cancellation charge for notice received more than 30 days before arrival; up to 50% of the accommodation price for notice received 30 to eight days before arrival and up to 100% for notice received seven days or less before arrival or non-arrival. The amount applied must remain reasonable in the circumstances and account for replacement occupancy and costs saved.
9.5
No cancellation charge will be imposed where the Client cannot honour the booking because of the death or hospitalisation of the person for whom, or for whose benefit, the reservation was made. ATILA may reasonably request confirmation of the circumstances. A statement of applicable costs and refunds will be provided, and the refundable balance will be paid within 30 days, or sooner where required by law.
9.6
A request to postpone an event may be made once by written notice at least six months before the original date, subject to availability of a new date within the following 12 months. Amounts previously paid will be credited to the revised booking. Any new date tariff and reasonable unrecoverable change costs must be disclosed before acceptance. A late or further postponement requires written agreement; if no new date is agreed, the ordinary cancellation principles apply.

10Cancellation by ATILA and events beyond control

10.1
If ATILA is unable to supply a confirmed booking for reasons within its reasonable control, it will advise the Client and may offer an appropriate alternative. If the Client declines an unsuitable change, ATILA will refund the affected booking payments without a cancellation charge and provide any further remedy required by law. ATILA will not unilaterally substitute a materially different date, venue or service.
10.2
Serious fire, flood, an exceptional natural occurrence, government prohibition or another event outside the reasonable control of the parties may prevent safe or lawful performance. The affected party must notify the other promptly. The parties will first consider an available alternative arrangement or date. Where performance is impossible and no alternative is accepted, payments for services not provided will be reconciled, subject only to reasonable, unavoidable costs that may lawfully be recovered.
10.3
Ordinary rain, routine interruption of power or water, avoidable equipment failure and ordinary staff shortages do not automatically excuse performance. ATILA may take reasonable steps to provide safe alternatives, reduce a compromised service or stop an activity where required by emergency circumstances, legal restrictions or the protection of people and property.

11Damage security, cleaning and personal property

11.1
A refundable damage security payment is required, the amount and due date of which must be confirmed in writing before the booking is accepted. The security covers proven loss, breakage, damage and additional cleaning attributable to the Client, Guests or their Service Providers.
11.2
A joint condition inspection may be arranged before use and a reasonable inspection may follow departure. ATILA may deduct the reasonable cost of cleaning, repair or fair replacement where supported by photographs, quotations, invoices or other evidence. The Client will receive an itemised account of deductions and may dispute any charge in writing.
11.3
ATILA will aim to notify the Client of any damage claim within seven days after departure and refund the undisputed balance of security within 14 days. Where a quotation is still awaited, only a reasonable estimate attributable to the disputed item may be retained pending prompt final calculation.
11.4
Approved biodegradable confetti requiring additional cleaning may attract a charge from R250 for the labour reasonably required. Where party poppers are expressly authorised and additional clearing is necessary, the published rates are R500 indoors and R700 outdoors.
11.5
Clients and Guests remain responsible for reasonable care of their vehicles and personal possessions. ATILA remains liable for loss caused by its own negligence or another legal basis that cannot be excluded. Items left behind may be held for up to 30 days while reasonable efforts are made to contact the owner, after which lawful storage, return or disposal arrangements may be made.

12Farm safety, supervision and conduct

12.1
The property includes free-roaming horses and other animals, a swimming pool without lifeguard supervision, open water, uneven or poorly lit terrain, steps, gravel, insects and possible snakes, candles, a boma, fireplaces, moving vehicles and temporary event installations. These conditions may result in serious injury, death or damage to property. The Client shall sign a separate Risk Declaration confirming that the associated dangers have been brought to their attention and understood before the booking is confirmed.
12.2
No person may approach, feed, touch, ride or enter an enclosure containing horses or farm animals without express authorisation and supervision by ATILA personnel. The use or operation of drones anywhere on the property is strictly prohibited. Guests must remain on designated paths and comply with all safety signage and instructions issued by authorised ATILA personnel.
12.3
Parents and guardians must ensure that children remain under continuous adult supervision, particularly near the swimming pool, animals, open water, vehicles, fire areas and children’s play facilities. Swimming pool operating hours are from 07:00 to 22:00. ATILA reserves the right to close the swimming pool when necessary. All safety notices displayed at the swimming pool and other areas of the property must be observed and strictly always adhered to.
12.4
Open flames are permitted only in designated areas and may be restricted during high fire-danger conditions. Fireworks, firecrackers, sky lanterns and pyrotechnics are prohibited. Vehicles must remain on authorised roads, travel at a safe speed and keep emergency access clear. Smoking and vaping are limited to designated areas.
12.5
Threatening, violent, discriminatory, harassing, unlawful or materially unsafe conduct is not permitted. ATILA may stop dangerous activity, refuse unlawful service or require a person to leave where proportionate and lawful. Injuries, hazards, damage and emergencies must be reported promptly to ATILA staff.
12.6
The Client must communicate the relevant farm rules and material safety warnings to invited Guests and Service Providers before their arrival and take reasonable steps to secure their compliance.

13Responsibility, liability and insurance

13.1
ATILA shall provide its services with the reasonable care and skill required by law and remains liable for loss or harm arising from its own negligence or breach of its legal obligations. ATILA will remain liable for gross negligence, and the Client retains all rights and remedies afforded by South African law.
13.2
The Client is responsible for direct loss or damage attributable to the Client’s breach, negligence or unlawful conduct and, to the extent legally attributable to the Client, that of invited Guests and independently appointed Service Providers. Any indemnity for a third-party claim is limited to a proven claim caused by such conduct and does not extend to ATILA’s own negligence or breach.
13.3
Neither party shall be liable for indirect or consequential loss that could not reasonably have been foreseen, except where such liability cannot lawfully be excluded. ATILA’s recommendation or approval of an independent Service Provider shall not constitute a warranty or guarantee of that Service Provider’s services, conduct or performance.
13.4
The Client is encouraged to consider appropriate event-cancellation insurance, supplier insurance and cover for valuable personal property. Any insurance required as a specific condition of an event must be disclosed before the booking is concluded.

14Privacy, photographs and intellectual property

14.1
ATILA will process relevant personal information lawfully under the Protection of Personal Information Act 4 of 2013 for enquiries, bookings, payments, guest registration, service delivery, safety, accounting and legal compliance. Personal information will be shared only where there is a lawful reason, including with necessary payment, booking, catering and professional service providers under appropriate safeguards.
14.2
Information relating to children, medical conditions, allergies or religious dietary requirements must be provided by a person authorised to do so and on a lawful basis. ATILA will limit access to sensitive information to those persons who reasonably require it for the relevant service or safety purpose.
14.3
Security cameras will operate in communal areas, access points and parking areas, excluding private accommodation units and bathrooms. Photographs or recordings identifying the Client or Guests will not be used for advertising or promotional purposes without their prior written consent. Commercial photography or filming on the property requires ATILA’s prior written approval.
14.4
ATILA may send electronic marketing communications unless the Client declines or unsubscribes. ATILA’s website Privacy Notice sets out how personal information is processed, data-subject rights and relevant contact details. ATILA retains all rights to its names, logos, website content, photographs, designs, documentation, templates, booking procedures, event-management systems, operational methods and independently developed business processes, as protected by intellectual property and confidentiality laws. Unauthorised reproduction, disclosure, distribution or commercial use is prohibited without ATILA’s prior written consent.

15Complaints, notices and general provisions

15.1
Any concern or incident must be reported immediately to ATILA’s Function Manager during the function or stay, allowing ATILA to investigate and take appropriate corrective action as soon as reasonably possible. Formal complaints, cancellation notices, refund requests and notices of breach must be submitted in writing to ATILA’s published booking or legal-notices email address. Informal communications shall not amend any confirmed booking or agreement unless accepted in writing by ATILA.
15.2
A material breach includes non-payment, unauthorised use of the property, serious or repeated safety violations, unlawful conduct, intentional damage, or failure to provide agreed essential services. The aggrieved party must give written notice identifying the breach and allowing seven days to remedy it, where capable of remedy, unless immediate action is justified by the seriousness of the breach or required by law.
15.3
A party raising a dispute must notify the other party in writing within seven days of becoming aware of the dispute. The parties shall first attempt to resolve the matter through good-faith discussions, failing which the dispute shall be referred to mediation. This procedure does not restrict a consumer’s right to approach the Consumer Goods and Services Ombud, National Consumer Commission, Information Regulator or a competent court, as provided by law.
15.4
The Terms and Conditions and ATILA’s business details, service descriptions, pricing, payment arrangements, cancellation and refund provisions and Privacy Notice, shall be accessible to the Client before any online booking is confirmed. ATILA shall provide written booking confirmation that the Client may retain, save or print.
15.5
Terms and Conditions are governed by the laws of the Republic of South Africa. Any provision found to be invalid or unenforceable shall be severed without affecting the validity of the remaining provisions. A failure or delay in exercising any right shall not constitute a waiver of that right. All consumer rights and remedies provided under the Consumer Protection Act, Electronic Communications and Transactions Act and other mandatory South African legislation remain protected.
